NOTIFICATION

In  exercise of the powers conferred by article 318 of the Constitution of India, the Governor of Tripura  is pleased to make the following regulations with respect to the composition and staff of the Tripura Public Service Commission, their tenure of office and condition of service.

PART - I
Preliminaries

1.    a.   The regulations may be called the Tripura Public Service Commission Regulations, 1972.
       b.   They shall extend to the whole of Tripura.
       c.    They shall come into force with immediate effect.  
            
2.                                       In these regulations, unless there is anything repugnant in the subject or context
i.        “Governor” means the Governor of Tripura.
ii.      “Chairman” means the Chairman of the Tripura Public Service Commission and includes the acting Chairman.
iii.    “Commission” means the Tripura Public Service Commission.
iv.    “Constitution” means the Constitution of India.
v.      “Member” means the member of the Tripura Public Service Commission and includes the Chairman.
vi.    “Secretary” means the Secretary of the Tripura Public Service Commission.]*

PART – II
Commission, composition and Pay

3.    [The Commission shall consist of a Chairman and other Members not less than one and not more than three]#
4.    A member of the Commission shall hold office for a term of six years farm the date on which the assumes office or until he attains the age of [ sixty two years ]**,whichever is earlier;

Provided that the Chairman or a Member of the Commission may, by writing under his hand, addressed to the Governor, resign his office earlier ;

Provided further that the Chairman or a Member of the Commission may be removed or suspended from office earlier in the manner provided in Article-317 of the Constitution.

5.           [(1)  The Chairman of the Tripura Public Service Commission shall receive pay in the scale of pay of Rs.22,400/= -525-24,500/= and each of the Members of the Commission in the scale of pay of Rs.18,400/-500-22,400/-  with effect from 1st day of November, 1999 ]*

             [ provided that a Chairman or a Member who on the date of his appointment as such was in the service of the Government of India or of any state Government shall be deemed to have retired from such service with effect from the date of his appointment as Chairman or Member.]*

[ Provided further that the Chairman or a Member who at the time of his appointment as Chairman or Member, is in service under the Government of India or under the Government of a state, shall subject to the provisions of regulation 10, continue to be governed during his term of office as such Chairman or Member, as regards retirement and pension, by the rules applicable to the service to which he belonged. ]#

            [ Provided (also)$ that if the Chairman or a Member has, prior to his appointment as Chairman or a Member of the Commission, retired from service under the Government of a State or Central, a local body or a University, he shall receive such pay as together with annuity or pensions before commutation which may have been sanctioned in respect of his previous service will be the amount admissible at different state in the scale of pay of Rs.2,400/-525-24,500/- a month in case of the Chairman and in the scale of pay of  Rs.18,400/-500-22,400/- a month in case of a Member. ]*

[2. The rules and orders relating to Dearness Allowance, House Rent Allowance, Medical Benefit applicable to the persons appointed to All India Services shall apply to the Chairman and Member.]@

[(3)$    Other terms and conditions shall be governed by the rules, orders and notification issued by the Government from time to time. ]*
PART – III
Leave
6.     A person who, immediately before  the date of assuming office as the Chairman or a Member, was in service of Government may earn and he granted during the tenure of office leave in accordance with the rules for the time being applicable to the service to which he belonged before such date and he shall be entitled to carry forward the amount of leave standing at his credit on such date notwithstanding anything contained in the proviso to  Clause – 5.

7.      A Chairman or any Member who at the date of his appointment as such was not in the    service of the Central or any State Government shall be granted leave according to the All India Service Leave Rules.        

8.       The power to grant or refuse leave to the Chairman or a Member and revoke or curtail the  leave granted to him shall vest in the Governor.

8 (A)   (1)  [The Chairman and the Member shall be paid cash equivalent of Leave Salary in respect of the period of the Earned Leave at his credit at the time of his ceasing to hold office. ]* 
(2) [The payment of cash equivalent of Leave Salary under sub-regulation (1) shall be limited to a maximum of 300 days;

Provided that if the Chairman or a Member, at the time of his appointment to the Commission, was in service and encased leave at the time of his retirement for a period of less than 300 days, he shall be allowed to encash the leave for the Balance period. ]#
  
(3) The cash equivalent of Leave Salary shall become payable to the Chairman and Member at the time of his ceasing to hold office and shall be paid in lump sum as a one time settlement. ]*

9.        When the Chairman is absent, on leave or otherwise for one month or more, the senior-most Member shall function as the acting Chairman and he shall be allowed a special pay of three hundred rupees in addition to his salary during such period.

PART – IV
Pension

10.  (1)   The service of the Chairman or a Member, who on the date of appointment as such is in pension able service, either under the Government of India or under the Government of a state, shall count towards pension, if any, admissible to him in that service, both his service and pay as a Member upto the date on which he retires or is superannuated from that service.

(2)  The Chairman or a Member who on the date of appointment as such in not in pension able service under the Government of India or under the Government of a state, shall be eligible to a terminal gratuity at the rate of half month’s pay for each period of 6 monthly service as Chairman or Member. ]#

PART – V

General Provident Fund

11.  (i)   A Chairman or a Member who at the date of his appointment was in the service of the Government of India or of a State and prior to that date had been admitted to the benefits of the General Provident Fund maintained by the Government, shall be eligible after appointment to continue to subscribe to the said fund on the same terms and conditions and subject to the same rules as previously.

(ii)   A Chairman or a Member to whom 11(i) is not applicable shall be enabled to contribute to Contributory Provident Fund under the normal rules, at his requests.

(iv)       The Rules and Orders relating to General Provident Fund applicable to the State Government employees of Tripura shall apply to the Chairman and to Members of the Commission ]*
PART - VI
Travelling and other allowances
[12 (1)   Leave Travel Concession of the Chairman or a Member of the Commission shall be regulated in the same manner and subject to the same conditions as are applicable to a Member of the Indian Administrative Service of the equivalent pay.    
(2)  The rules and orders relating to Traveling Allowance and Compensatory Allowance applicable to persons appointed to Group-A of the State Government services shall apply to the Chairman and a Member.]**

13.    A Chairman or a Member shall be entitled to the facilities for medical treatment and accommodation in hospital according to the rules for the time being applicable to a member of the Indian Administrative Service of equivalent pay.
14.      An advance for the purchase of a motor car to a Chairman or a Member will be regulated by the appropriate rules in force applicable to State Government servants drawing comparable pay.
PART – VII
Staff of the Commission and their service conditions
15.      The staff of the Commission may include a Secretary, [Joint Secretary]* /a Deputy/Under Secretary, a Section Officer and such other gazetted and non-gazetted staff as the Governor may from time to time determine in consultation with the Commission.
16   (1) The Secretary shall be appointed by the Commission with the approval of the Governor.
 (2) The Joint/Deputy/Under Secretary, Controller of Examinations, Tabulation Officer, Research Officer, Accounts Officer, Senior Librarian and Section Officer shall be appointed by the Commission and they shall receive such emoluments as are admissible to Government servant of corresponding grades in the Tripura Civil Secretariat.]*
17.       The conditions of the service of the Section Officer shall be corresponding to those applicable to the Section Officer in Tripura Civil Secretariat.
18.       The Ministerial non-gazetted staff and the class-IV staff shall be appointed by the Secretary (with the approval of the Commission)* and they shall receive such empluments as admissible to the Government servants of corresponding grades in the Tripura Civil Secretariat.
19.    The Commission, in case of the gazetted officer and the Secretary, in case of the non- gazetted staff including the class-IV staff, shall be the authority who may impose any of the penalties prescribed in the Civil Services (Classification, Control & Appeal) Rrules,1965 and the Governor in respect of the gazetted officers and the Commission, in respect of the non-gazetted staff, including the class-IV staff, shall be the Appellate Authority.]**
PART – VIII
20.     In respect of any matter for which no express provision has been made in the Regulations, the conditions of the service of the officers and other staff of the Commission shall be governed by the rules and orders for the time being applicable for such class of Government servants of corresponding grades of the Tripura Secretariat Service. ]*

21.If any doubt arises about the interpretation of any of these regulations, interpretation of the Governor shall be final.
